Abstract
U ovom radu obrađuje se pojam krivnje u hrvatskom kaznenom pravu kao subjektivnog odnosa počinitelja prema djelu zbog kojeg se može izreći prijekor počevši od razvoja pojma krivnje i prijelaza na subjektivnu odgovornost kroz razna društvena uređenja. Dalje se analizira ubrojivost kao prvi element krivnje, kako se ona utvrđuje, koji su njezini temelji, vrste ubrojivosti i konačno koja je pravna posljedica utvrđivanja ubrojivosti odnosno neubrojivosti. Razlažu se namjera i nehaj kao oblici krivnje te njihovi stupnjevi i intelektualne sastavnice. Objašnjava se pojam svijesti o protupravnosti kao sastojku krivnje i odnosu prema namjeri. U posljednjem djelu rada ukratko su analizirani ispričavajući razlozi, krajnja nužda i prekoračenje granica nužne obrane kao novina u hrvatskom kaznenom pravu.
Abstract (english)
This paper deals with the concept of culpability in the Croatian criminal law as a subjective attitude of the perpetrator towards the act for which a reprimand can be imposed. It starts with the development of the concept of culpability and transitions to the subjective responsibility. Furthermore, accountability is analyzed as the first element of culpability- how it is determined, what are its bases, types of accountability, and finally what is the legal consequence of determining accountability or non-accountability. Intent and negligence are explained as forms of culpability, as well as their degrees and intellectual components. The concept of awareness of illegality as an ingredient of culpability and the attitude towards intent are explained. In the final part of the paper, the grounds of excuse, the necessity and the exceeding of limits of self-defense as new features in the Croatian criminal law are briefly presented.
