Abstract
U ovome radu obrađivati će se tema „Disciplinska odgovornost državnih službenika za povrede službene dužnosti“. Definirati će se svrha disciplinskog postupka u društvu te definirati i pobliže objasniti zakonsko uređenje disciplinske odgovornosti državnih službenika u Republici Hrvatskoj. Navesti će se i tijela pred kojima se disciplinski postupak vodi, način na koji se postupak pokreće, pravni lijekovi koji se mogu izjaviti protiv odluke donesene u u disciplinskom postupku, te rokovi protekom kojih nastupa zastara u disciplinskom postupku. Nabrojati će se ponašanja koja se smatraju povredama službene dužnosti, navesti će se propisane sankcije koje se mogu izreći državnom službeniku koji počini povredu službene dužnosti, te će se propisane povrede i sankcije usporediti sa propisnim povredama i sankcijama u zakonodavstvima Republike Srbije i Bosne i Hercegovine.
Abstract (english)
This paper will address the topic „Disciplinary liability of state officials for breaches of official duty“. The purpose of disciplinary proceedings in the society will be defined and legal regulations of disciplinary liability of state officials in Republic of Croatia will be defined and explained in more detail. In addition, the bodies before which the disciplinary procedure is conducted, the manner in which the procedure is initiated, legal remedies that can be declared against the decision made in the disciplinary procedure, and the deadlines for the expiration of the statute of limitations in the disciplinary procedure will be stated. Also, behaviours that are considered breaches of official duty will be listed and so will the prescribed sanctions that may be imposed on a state official who commits a breach of official duty. Finally, the prescribed breaches and sanctions will be compared with prescribed breaches and sanctions in the legislation of Serbia and Bosnia and Herzegovina.
