Abstract
U ovom radu analizira se jedno od temeljnih ljudskih prava, pravo na slobodu izražavanja. Na početku rada navode se odredbe nacionalnih i međunarodnih dokumenata kojima je sloboda izražavanja zaštićena ali i kada i pod kojima uvjetima se ona iznimno može ograničiti. Zatim se objašnjavaju kaznena djela protiv časti i ugleda koja predstavljaju ograničenje slobode izražavanja. Drugi dio rada usmjeren je na određivanje granica između prava na slobodu izražavanja i prava na privatnost. Prikazat ćemo kakav utjecaj imaju mediji i novinari u društvu te kada će novinarstvo biti ograničeno pravom pojedinca na privatnost i poštivanje časti i ugleda. Objasnit ćemo govor mržnje, njegov cilj i kako je sankcioniran u hrvatskom zakonodavstvu. Na kraju rada analizirat ćemo presude Ustavnog suda i Europskog suda za ljudska prava i na taj način prikazati koja su osnovna načela i kriteriji koja se primjenjuju kako bi se uspostavila ravnoteža između suprotstavljenih prava, odnosno odredile granice slobode izražavanja i prava na poštivanje časti i ugleda.
Abstract (english)
This paper analyzes one of the fundamental human rights, the right to freedom of expression. At the beginning of the paper, the provisions of national and international documents by which freedom of expression is protected are stated, but also when and under what conditions it can be exceptionally limited. For explaining criminal offenses against honor and reputation that constitute a restriction on freedom of expression the second part of the paper focuses on defining the boundaries between the right to freedom of expression and the right to privacy. We will also show what influence the media and journalists have in society and when the newspaper will be limited by the individual’s right to privacy and respect for honor and reputation. We will explain hate speech, its goal and how it is sanctioned in Croatian legislation. At the end of the analysis, we will present the judgments of the Constitutional Court and the European Court of Human Rights and thus show the basic principles and criteria applied to establish a balance between opposing rights, i.e. determine the limits of freedom of expression and the right to respect for reputation.
