Abstract
Ovaj diplomski rad obrađuje područje ustavnopravnih aspekata Domovinskog rata. Fokus rada je ustavnopravni prikaz izgradnje suvereniteta i neovisnosti Republike Hrvatske u vrijeme Domovinskog rata. Početak rada obrađuje hrvatski ustavnopravni položaj u sastavu SFRJ te prikazuje one okolnosti koje su bile ključne za nastanak Republike Hrvatske nakon raspada SFRJ. Središnji dio rada govori o nekoliko ključnih temelja na kojima je izgrađen suverenitet Republike Hrvatske. Ti temelji su neotuđivi suverenitet koji je hrvatski narod imao održavajući svoj državnopravni kontinuitet u svim državnim zajednicama do 1990.godine, ustavnopravne odluke Hrvatskog sabora i obrana tih ustavnih odluka u Domovinskom ratu. Kraj rada sadrži mišljenja Arbitražne komisije u okviru Mirovne konferencije u Jugoslaviji te na koji je način Domovinski rat imao utjecaj na međunarodno priznanje Republike Hrvatske koje je dalo dodatni legitimitet u dokazivanju suverenosti i neovisnosti Republike Hrvatske.
Abstract (english)
This paper deals with the area of constitutional aspects of the Homeland War. The focus of the paper is the constitutional review of the building of the sovereignty and independence of the Republic of Croatia during the Homeland War. The beginning of the paper deals with the Croatian constitutional position within the SFRY and shows those circumstances that were crucial for the emergence of the Republic of Croatia after the disintegration of the SFRY. The central part of the paper discusses several key foundations on which the sovereignty of the Republic of Croatia is built. These foundations are the inalienable sovereignty that the Croatian people had by maintaining their state legal continuity in all state communities to 1990, the constitutional decisions of the Croatian Parliament and the defense of these constitutional decisions in the Homeland War. The end of the paper contains the opinions of the Arbitration Commission within the Peace Conference in Yugoslavia and how the Homeland War had an impact on the international recognition of the Republic of Croatia, which gave additional legitimacy in proving of the sovereignty and independence of the Republic of Croatia.
