Abstract
Prava, obveze i odgovornost carinskih službenika, kao državnih službenika u Carinskoj upravi Republike Hrvatske, propisane su odredbama zakona i propisa o državnim službenicima i posebnim zakonima. Propisanim načelima carinski službenici odgovorni su osigurati učinkovito i zakonito obavljanje službenih zadaća, te zaštiti čast i ugled službenika i službe. Postupanje suprotno tim načelima, odnosno povrede zakonskih obveza i pravila struke podliježe odgovornosti za povredu službene dužnosti, te za svako tako protupravno djelo počinjeno namjerno ili iz nehaja službenik snosi disciplinsku odgovornost. Odgovornost za povredu službene dužnosti je odgovornost službenika za povredu zakonskih obveza i pravila struke, za koju se u propisanom postupku od strane nadležnog tijela izriče zakonom određena kazna. Disciplinski postupak vodi se u slučaju kad je utvrđeno ili postoji osnovana sumnja da je državni službenik počinio povredu službene dužnosti (lakšu ili težu) u obavljanju državne službe.
Abstract (english)
The rights, obligations and responsibilities of customs officers, as civil servants in the Customs Administration of the Republic of Croatia, are governed by the provisions of laws and regulations on civil servants and special laws. According to the prescribed principles, customs officers are responsible for ensuring the efficient and lawful performance of official duties, and for protecting the honor and reputation of officials and services. Acting contrary to these principles, i.e. violation of legal obligations and rules of the profession is subject to liability for violation of official duty, and for any such illegal act committed intentionally or negligently, the official bears disciplinary responsibility. Liability for breach of official duty is the liability of an official for breach of legal obligations and rules of the profession, for which a statutory penalty is imposed by the competent authority in the prescribed procedure. Disciplinary proceedings are conducted in the case when it has been established or there is a grounded suspicion that a civil servant has committed a violation of official duty (minor or serious) in the performance of civil service.
