Abstract
Razvojem međusobne suradnje između država članica Europske unije dolazi do širenja zajedničkih interesa, što je izravno rezultiralo i usvajanjem novih vrijednosti oko kojih se stvorilo jedinstveno tržište, jedno od temeljnih vrijednosti Europske unije. Nastavno na uspostavu jedinstvenog tržišta Europske unije i ukidanje graničnih kontrola trgovine između država članica, nužnim se nameće neophodnost njihove suradnje u cilju učinkovitog utvrđivanja porezne obveze, identifikacije poreznog obveznika, sprečavanja porezne utaje, prevencije pranja novca i naplate porezne obveze. S tim u svezi, cilj ovog rada je pobliže prikazati kako funkcionira sustav administrativne suradnje i suzbijanja poreznih prijevara među državama članicama Europske unije posebice u području poreza na dodanu vrijednost kao najznačajnijeg i najizdašnijeg poreza, kako funkcionira instrument usporednih odnosno multilateralnih nadzora koje predlažu i provode nadležna tijela dviju ili više članica provođenjem usporednih poreznih nadzora na nacionalnom području kod jednog ili više poreznih obveznika povezanih zajedničkim ili vezanim interesima radi razmjene nužnih podataka, te opisati postupak administrativne suradnje među državama članicama u području naplate tražbina po osnovi poreza i drugih javnih davanja. Sustav administrativne suradnje doprinosi osiguravanju jednakosti i nediskriminacije u području oporezivanja: pomaže osigurati da svi plaćaju svoje porezne obveze, pomaže u sprečavanju porezne prijevare i pomaže u sprečavanju proračunskih gubitaka kako država članica tako i Europske unije u cjelini.
Abstract (english)
The development of mutual cooperation between the Member States of the European Union leads to the spread of common interests, which directly resulted in the adoption of new values around which the single market was created, one of the fundamental values of the European Union. In addition to the establishment of the single market of the European Union and the abolition of border controls on trade between Member States, it is necessary to cooperate in order to effectively determine the tax liability, identify the taxpayer, prevent tax evasion, prevent money laundering and collect taxes. In this regard, the aim of this paper is to show in more detail how the system of administrative cooperation and combating tax fraud among EU Member States works, especially in the field of value added tax as the most important and most generous tax, how the instrument of comparative or multilateral controls proposed and implemented authorities of two or more Member States by carrying out comparative national tax inspections of one or more taxpayers linked by common or related interests in order to exchange the necessary information, and describe the procedure for administrative cooperation between Member States in collecting taxes and other public levies. The system of administrative cooperation contributes to ensuring equality and non-discrimination in the field of taxation: it helps to ensure that everyone pays their tax obligations, helps prevent tax fraud and helps prevent budget losses for both the Member States and the European Union as a whole.
