Abstract
U ovom radu autorica se bavi sudskim razvrgnućem suvlasništva. Pobliže se analizira sam institut suvlasništva, tko ima pravo na razvrgnuće, ograničenje prava, način ostvarivanja, te pravna priroda zahtjeva za razvrgnuće. Zatim se objašnjava razlikovanje sporazumnog od sudskog razvrgnuća. Unutar sudskog razvrgnuća detaljno se objašnjavaju načini razvrgnuća koji su tipizirani u hrvatskom pravu. Zatim se daje prikaz vođenja postupka, njegove specifičnosti u izvanparničnom i parničnom postupku. Na kraju rada daje se komparativni pregled pravnog uređenja u Austriji i Njemačkoj.
Abstract (english)
In this paper, the author deals with the judicial dissolution of co-ownership. The institute of co-ownership itself is analyzed in more detail, who has the right to dissolution, the restriction of rights, the manner of exercise, and the legal nature of the petition for dissolution. The distinction between consensual and judicial dissolution is then explained. Within the court dissolution, the methods of dissolution that are typified in Croatian law are explained in detail. Then, an overview of the conduct of the procedure, its specificity in non-litigation and litigation proceedings is given. At the end of the paper, a comparative overview of the legal system in Austria and Germany is given.
