This graduate thesis deals with the limitation of liability of shipowner (operator) in a way that first describes the difference between shipowner and operator. Furthermore, a distinction has been made between the responsibility of the shipowner (shipping company), which is divided into contractual and non- contractual liability.The limitation of liability of shippers- a system of general and specific constraint of liability - is then analysed and the reasons for limiting liability are analysed. An integral part of this paper is the historical system of general limitation of responsibility - the abandona system (Mediterranean system), the execution system (German system), the English system. Furthermore, the paper compares international conventions and protocols regarding the limitation of liability, as well as claims which are subject to a limitation of liability and claims which are not subject to a limitation of liability. The paper presents a comparison regarding the procedure for limiting the liability of shippers in accordance with the Act on Amendments to the Maritime Code of 2019, while the completion of the work refers to the fund limiting the liability of shippers as an institute by which the shippers limit their liability in order to reduce the economic risk for shippers, while the injured party is provided with certain certainty that they will recover their damages.
