Abstract
Predmet ovog diplomskog rada je ugovor o cesiji ili ustupu tražbine. To je ugovor kojim cedent (stari vjerovnik) prenosi na cesionara (novog vjerovnika) tražbinu koju ima prema cesus (dužniku). Iako kod cesije susrećemo tri subjekta, riječ je o dvostranom pravnom poslu koji je perfektan u trenutku sporazuma cedenta i cesionara. Može biti zaključen u usmenom i pismenom obliku. Premda za nastanak i valjanost ugovora o cesiji nije potreban pristanak dužnika, on mora biti obaviješten (notifikacija dužnika). Osim redovne cesije razlikuju se sljedeći oblici ustupanja tražbine: cesija umjesto ispunjenja, cesija radi ispunjenja i cesija radi osiguranja.
Abstract (english)
The subject of this diploma paper is the contract on cession or assignment of the claim. It is a contract by which the assignor (old creditor) transfers to the assignee (new creditor) the claim he has against the cesus (debtor). Although we encounter three subjects in the case of cession, it is a bilateral legal transaction is perfect at the time of the agreement between the assignor and the assignee. It can be concluded orally and in writing. Although the debtor's consent is not required for the creation and validity of the assignment agreement, it must be notified (notification of the debtor). In addition to regular assignment, the following forms of assignment of a claim are distinguished: assignment instead of fulfillment, assignment for fulfillment and assignment for insurance.
