Abstract
Predmet ovog rada je upoznavanje i razumijevanje pravnog instituta dobrovoljne hipoteke koja se osniva na nekretninama primjenjujući temeljna načela založnog prava. Hipoteka predstavlja institut stvarnog prava kojim se pojačava obveznopravni odnos tako što založni vjerovnik stječe pravo namirenja iz vrijednosti opterećene nekretnine ukoliko dužnik ne ispumi svoju obvezu u roku. U radu se obrađuju osnovna obilježja založnog prava, prava i obveze sudionika, pojašnjavaju se prepostavke osnivanja s naglaskom na hipotekarni ugovor i upis u zemljišne knjige kao način stjecanja te specifični putevi zasnivanja i raspolaganja hipotekom.
Abstract (english)
The subject of this paper is the introduction and understanding of the legal institute of voluntary mortgage, which is established by applying the basic principles of lien. A mortgage is an institute of real estate law which reinforces the legal relationship so that the pledgee acquires the right to settle from value of the encumbered real estate if the debtor does not pay his obligation within the time limit. The paper deals with the basic features of the lien, rights and obligations of participants, explains the preconditions for establishment with an emphasis on the mortgage agreement and registration in the land register as a method of acquisition and specific ways of establishing and disposing of the mortgage.
