Abstract
Migrant crisis that has enveloped Europe in the last decade resulted in a clash between European legal tradition and Sharia Law, forcing the member states of the EU to look at the foreign legal system more thoroughly, to try to find solutions for the problems that are inevitable to come up. This paper deals with several specific instruments of Islamic law that nowadays often raise issues in European legal systems. More precisely, it deals with a peculiar Islamic system of adoption called kafala, as well as methods that are used to end the marriage in Islamic world, called faskh and talaq. This paper deals with basic notions of Islamic Divorce (talaq) and Islamic Adoption (kafala), traditional legal responses (Universal Unification and Hague Conference on Private International Law as well as Regional European Considerations), new moments and legal challenges that arise from kafala and talaq. Paper strives at summarizing the moments related to implications of Islamic law to European practice. It will lean on a rich history of responses provided by jurisdictions that traditionally dealt with these issues. Further, the practice of European Court of Human Rights as well as that of the Court of EU will be taken into account. In the end, this paper aims at offering a perspective on the attitude that should be employed by the European countries that are dealing with the matter for the first time in modern times.

Migrantska kriza koja je zatekla Europu u posljednjem desetljeću rezultirala je srazom Europske pravne tradicije i Šerijatskog prava, prisiljavajući države članice EU da detaljnije prouče ovaj strani pravni sustav te da pokušaju pronaći rješenja za probleme koji su neizbježni. Ovaj rad bavit će se s nekoliko specifičnih instrumenata islamskog prava koji u zadnje vrijeme često problematični u europskim pravnim sustavima. Preciznije, bavit će se jedinstvenim islamskim sustavom posvojenja - kafalom, te metodama koje su korištene za prestanak braka u islamskom svijetu – faskh i talaq. Ovaj rad bavit će se osnovnim pojmovima islamskog razvoda (talaq) te islamskog posvojenja (kafala), tradicionalnim pravnim odgovorima (univerzalnom unifikacijom, Haškom konferencijom za međunarodno privatno pravo, kao i regionalnim europskim razmatranjima), novim kretanjima i pravnim izazovima koji proizlaze iz islamskog razvoda (talaq) i kafale. Ovim radom planira se sažeti nove implikacije i kretanja islamskog prava na europsku praksu. Oslanjat će se na bogatu povijest odgovora na ta pitanja donesenih u državama koje su tradicionalno u doticaju s tim problemima. Nadalje, praksa Europskog suda za ljudska prava kao i Suda EU biti će uzeta u obzir. Na kraju, ovim radom namjerava se ponuditi perspektiva na to koji stav europske države koji se u današnje vrijeme prvi put susreću s ovim pitanjima trebaju zauzeti.
