Abstract
U radu je obrađeno kazneno djelo genocida. Prikazan je razvoj pojma genocida kroz povijest te neki od najpoznatijih i najvećih genocida. Pojam genocida je definiran u Konvenciji o sprečavanju i kažnjavanju zločina genocida iz 1948. godine. Nadalje, prikazan je uvid genocida u domaćem zakonodavstvu te pretpostavke koje se moraju ispuniti kako bi se moglo govoriti o kaznenom djelu. Genocid je moguće počiniti kroz pet modaliteta počinjenja. Nije potrebno kumulativno ostvarenje, već je dovoljno postupanje samo po jednom modalitetu. Kako bi se utvrdilo postojanje genocida, potrebno je postupati sa genocidnom namjerom uništenja zaštićene nacionalne, rasne, etničke ili vjerske skupine. Moguće ga je počiniti i samo prema jednom pripadniku skupine te i u vrijeme mira. Za počinjenje genocida postoji dualitet individualne odgovornosti pojedinca i odgovornost države. Rimskim statutom ustanovljen je Međunarodni kazneni sud čija je zadaća kažnjavanje navedenog zločina.
Abstract (english)
This research paper presents the crime of genocide. It presents the developmnet of the concept of genocide trough history and some of the most known and greatest genocides. The term genocide is defined in the 1948 Convention on the Prevention and Punishment of the Crime of Genocide. Furthermore, an insight into genocide in domestic law is presented, as well as the assumptions that must be fulfilled in order to speak of a crime. Genocide can be committed through five modalities of perpetration. No cumulative implementation is required, but only one modality is sufficient. Genocidal intent to destroy a protected national, racial, ethnic or religious group is required to determine genocide. Genocide can be committed against one member of the group and in times of peace. For committing genocide, there is the duality of individual responsibility of the individual and the responsibility of the state. The Rome Statute establishes the International Criminal Court, whose task is to punish the crime of genocide.
