Abstract
Predmet ovog diplomskog rada je obiteljska medijacija kao institut koji je u svom sadašnjem sadržaju uveden Obiteljskim zakonom 2015. godine. Obiteljska medijacija je proces kojemu pristupaju stranke u situacijama narušenih obiteljsko-pravnih odnosa kojim se nastoje riješiti nastale nesuglasice posebno ukoliko su u to uključena i djeca. Medijator kao treća osoba svojim znanjem i vještinama upućuje stranke u njihova prava te pomaže u usmjeravanju na postizanje dogovora. Temeljna načela obiteljske medijacije su načelo dobrovoljnosti prema kojemu se strankama pruža mogućnost izbora sudjelovanja u postupku obiteljske medijacije, kao i načelo zaštite njihove privatnosti. Medijacija se pokreće na zahtjev stranke, a iznimka od dobrovoljnosti postoji u slučaju kad roditelj prije pokretanja postupka razvoda braka nisu postigli dogovor o zajedničkoj roditeljskoj skrbi, kada je prvi sastanak s obiteljskim medijatorom obvezan. Proces obiteljske medijacije okončava se donošenjem plana o zajedničkoj roditeljskoj skrbi ili drugim sporazumima koje stranke mogu postići u postupku.
Abstract (english)
The subject of this diploma thesis is family mediation as an institute introduced in its current content by the Family Law in 2015. Family mediation is a process that is approached by the parties in situations of broken family-legal relationships that seek to resolve the disagreements, especially if children are involved. The mediator, as a third party, with his knowledge and skills, instructs the parties in their rights and helps direct them to reach an agreement. The basic principles of family mediation are the principle of voluntariness according to which the parties are given the opportunity to choose to participate in the family mediation process, as well as the principle of protecting their privacy. Mediation is initiated at the request of the party, with the exception of voluntariness when the parent has not reached an agreement on joint parental care before initiating the divorce proceedings, when the first meeting with the family mediator is mandatory. The family mediation process ends with the adoption of a joint parental care plan or other agreements that the parties may reach in the process.
