Abstract
Tema ovog rada jesu obilježja ropstva i trgovanja ljudima te njihova zabrana u hrvatskom i međunarodnopravnom zakonodavstvu. Detaljno se analizira sličnost koja postoji između kaz-nenih djela trgovanja ljudima i ropstva, kao i sličnost koju ta kaznena djela imaju prema dru-gim kažnjivim djelima. Za razvoj pojma trgovanja ljudima i ropstva bitan utjecaj imala je sud-ska praksa, prvenstveno Europski sud za ljudska prava koji svojim presudama daje novo tuma-čenje specifičnih obilježja navedenih kaznenih djela. Zato se u ovom radu posebna pažnja uka-zuje na djelovanje Europskog suda za ljudska prava kao i na njegov utjecaj u donošenju presu-da. Možemo zaključiti da pravne norme pokušavaju dostići razvoj i promjene u načinu odvija-nja ropstva i trgovanja ljudima, no za njihovo efektivno djelovanje one moraju ići ukorak s njima, te se zajednički razvijati kako bi uspješno zabranjivale sve suvremene oblike tih pojava.
Abstract (english)
The topic of this paper is the characteristics of slavery and trafficking in human beings and their prohibition in Croatian and international law. The similarity between the crimes of traf-ficking in human beings and slavery is analyzed in detail, as well as the similarity between these offenses against other offenses. The development of the notion of trafficking in human beings and slavery has been significantly influenced by the case law, primarily the European Court of Human Rights, which gives, with it's judgments, a new interpretation of the specific features of these offenses. That is why, in this paper, particular attention is paid to the work of the European Court of Human Rights and it's influence through the delivery of judgments. We can conclude that legal norms seek to fallow the development and changes in the way slavery and trafficking take place, but for their effective action they must keep pace with them and develop together to successfully ban all contemporary forms of these phenomena.
