Abstract
U radu je prikazan institut uvjetne osude kao kaznenopravne sankcije koja se najčešće primjenjuje unutar kaznenog sustava Republike Hrvatske. Cilj ovog diplomskog rada je dati uvid u primjenu uvjetne osude u našem kaznenom zakonodavstvu, objasniti povijesni razvoj ovog instituta, odrediti koje se pretpostavke moraju ispuniti da bi uopće moglo doći do primjene uvjetne osude, utvrditi razliku između primjene djelomične uvjetne osude i „obične“ uvjetne osude te u konačnici pojasniti kada, zašto i kako dolazi do opoziva izrečene uvjetne osude. Zadnji dio rada sastoji se od analize primjene ove sankcije u praksi na razini Republike Hrvatske, ali i pojedinačno na području Općinskog suda u Osijeku.
Abstract (english)
This research paper presents the institution of the suspended sentence as a criminal sanction which is commonly imposed within the criminal justice system of the Republic of Croatia. The objective of this graduation thesis is to provide an insight into the granting of suspended sentence within our criminal legislation system, as well as to explain the historical development of the afore-mentioned institution and to determine the prerequisites that need to be met in order for the suspended sentence to be granted, determine the difference between the implementation of a partially suspended sentence and the regular suspended sentence, ultimately providing the explanation of when, why and how a suspended sentence pronounced by the court can be revoked. The final chapter of the thesis includes the analysis of the application of the afore-mentioned sanction in practice at the national level, as well as at the individual municipality level on the territory within the jurisdiction of the Municipality Court in Osijek.
