Maritime domain is public domain and domain of interest for the Republic of Croatia which takes care, maintains it and is responsible for it. Maritime domain is based on the principle of legal unity of real property, and on the principle that property in that area is outside the property regime. Maritime domain has always been an area of great importance and the most interesting part of state territory. Though in various cases, the feature that it is maritime domain is not registered in land registry, therefore, it was exposed to various forms of devastation. The object of this paper is possibility of establishment property rights, especially right of ownership in maritime domain, which is caused by the lack of harmonization of positive legal regulation. This paper analyzes opportunities of acquiring right of ownership according to the previous legal regulation and the ways of how those situations are solved today. Lack of the obligation to establish borders od maritime domain and the lack of obligation to register it in land registry represents big drawbacks in maritime domain. Those kinds of problems have to be solved in order to determined the zone of maritime domain in which it is possible to acquire property rights. That zone can be separated from other real estates and the maritime domain can be under appropriate wealth protection. Unresolved property legal issues in maritime domain have an impact on its economic use and the legal regime of concessions.
