Abstract U diplomskom radu riječ je o Ustavnom sudu Republike Hrvatske, njegovoj povijesti, aktima koji uređuju njegovo djelovanje, njegovom ustrojstvu, tijelima i dužnostima, nadležnosti koja je taksativno određena Ustavom Republike Hrvatske, postupcima koje provodi, a koje uređuje Ustavni zakon o Ustavnom sudu Republike Hrvatske te o nedavnoj krizi koju je Ustavni sud pretrpio zbog neizbora sudaca Ustavnog suda. Ustavni sud Republike Hrvatske najviše je ustavno tijelo Republike Hrvatske koje jamči poštovanje i primjenu Ustava Republike Hrvatske. Ustavni sud može se definirati kao posebno ustavno tijelo koje je neovisno o ostalim granama državne vlasti te nije instancijski sud, a svoje djelovanje temelju na odredbama Ustava Republike Hrvatske i Ustavnog zakona o Ustavnom sudu Republike Hrvatske.Ustavni sud čini trinaest sudaca koje bira Hrvatski sabor na prijedlog Odbora za Ustav, Poslovnik i politički sustav i to dvotrećinskom većinom glasova svih zastupnika na vrijeme od 8 godina te nema ograničenja reizbora.Nadležnost Ustavnog suda taksativno je određena Ustavom Republike Hrvatske, a postupke koje Ustavni sud provodi na osnovi tako određene nadležnosti propisuje Ustavni zakon o Ustavnom sudu.Zaključno, Ustavni sud je najvažnija institucija zaštite ustavnih prava i sloboda u modernom demokratskom društvu, on osigurava političku ravnotežu između zakonodavne, izvršne i sudbene vlasti koju ta tijela ne mogu uzajamnim djelovanjem osigurati, nego je potreban institucionalni nadzor ustavnosti njihovog djelovanja putem posebnog ustavnog tijela.
Abstract (english) This diploma paper is about the Constitutional Court of the Republic of Croatia, its history, acts governing its operation, its organization, authorities and duties, jurisdiction, which is exhaustively determined by the Constitution of the Republic of Croatia, the procedures implemented and governed by the Constitutional act on the Constitutional Court and the recent crisis which the Constitutional court had suffered due to the non-election of judges.Constitutional Court of the Republic of Croatia is the highest constitutional authority of the Republic of Croatia, which guarantees respect and implementation of the Constitution of the Republic of Croatia. The Constitutional Court can be defined as a special constitutional body that is independent from the other branches of state power and is not jurisdiction court, and his actions are based on the regulations of the Constitution of the Republic of Croatia and the Constitutional act on the Constitutional Court of the Republic of Croatia.The Constitutional Court consists of thirteen judges elected by the Croatian Parliament at the proposal of the Committee for the Constitution, and political system for which is needed two-thirds majority vote of all the members, for a term of eight years and there is nolimitation of re-election.The jurisdiction of the Constitutional Court is exhaustively determined by the Constitution of the Republic of Croatia, and procedures of the Constitutional Court which are carried out on the basis of specified responsibilities prescribed by the Constitutional act of the Constitutional Court.In conclusion, the Constitutional Court is the most important institution of protection of constitutional rights and liberties in a modern democratic society, he is providing political balance between the legislative, executive and judicial powers, which these bodies cannot provide by mutual interaction, but are in need of institutional control of the constitutionality of their actions through a special constitutional body.
