Abstract
U ovome radu obrađuje se problematika trgovanja ljudima, njegovi elementi, faze, odnos s krijumčarenjem, pojavni oblici, te regulacija kroz razne međunarodne dokumente i zaštita žrtava trgovanja ljudima. Također, navodi se presuda Europskog suda za ljudska prava Rantsev protiv Cipra i Rusije, u kojoj se navodi povreda članka 4. Europske konvencije za zaštitu ljudskih prava i temeljnih sloboda, iako u tome članku izrijekom nije navedeno da se radi o trgovanju ljudima. Odnosna presuda predstavlja pomak u zaštiti žrtava trgovanja ljudima. Nadalje, piše se o inkriminaciji u hrvatskom zakonodavstvu, odnosu staroga Kaznenog zakona i novoga od 2011. godine (stupio na snagu 1.1.2013.g. ).
Abstract (english)
The paper deals with the concept of trafficking in human beings, which are its elements, phases, relation to smuggling of people, manifest forms and regulation through various international documents and the protection of victims of trafficking in human beings. Also, the judgment of the European Court of Human Rights Rantsev v. Cyprus and Russia is cited, alleging a violation of Article 4 of the European Convention for the Protection of Human Rights and Fundamental Freedoms, although this Article does not explicitly state that this is a case of trafficking in human beings. The judgment represents a step forward in the protection of victims of trafficking in human beings. Furthermore, it is written about the incrimination in Croatian legislation, the relationship between the old criminal law and the new one from 2011 (entered into force on 1 January 2013).
