Abstract
Uvijek aktualan i svima poznat u svijetu problem je zlouporabe droga. Možemo reći da je droga postala globalna industrija modernog vremena koja se uvukla u svaku zemlju i ozbiljno prijeti društvu. Na svakom koraku postavljaju se pitanja kako ga riješiti i da li je uopće moguće riješiti taj problem s obzirom da ne bira društvene slojeve niti zajednice. Taj nezaobilazan problem suvremenog društva na glasu je kao jedan od važnijih i u Republici Hrvatskoj. Današnji ciljevi očitavaju se u smanjenju potražnje i ponude, odnosno uklanjanju rizičnih čimbenika. Zakonodavstva posežu za prevencijama, rehabilitacijom i resocijalizacijom, ali i učinkovitom kaznenom sankcijom. Kako bi popratila trendove, Hrvatska je također posegnula za suvremenim zakonodavstvom i to promjenom Kaznenog zakona u kojem se ostavlja sankcioniranje najtežih povreda i ugrožavanje društva, dok kod povreda nižeg stupnja primjenjuje se prekršajno zakonodavstvo koje je koje je u posljednje vrijeme došlo do izražaja usvajanjem novog rješenja kad je riječ o zlouporabi droga. Cilj ovog rada je istražiti zakonodavne mehanizme Republike Hrvatske u području sprječavanja zlouporabe droga, najnovije promjene u tom području, stavove hrvatskog pravosuđa te dati vlastiti osvrt na ovu problematiku.
Abstract (english)
Always actual and known everywhere in the world is a problem of drug abuse. We can say that the drug has become the global industry of modern times which has penetrated every country and seriously threatens society. At each step, questions are asked regarding how to solve this problem and whether it is possible to solve it at all, since it does not choose social groups or communities. This unavoidable problem of contemporary society is one of the most imortant voice in the Republic of Croatia. Today's goals are reflected in reducing demand and supply, or eliminating risk factors. Legislation is for prevention, rehabilitation and re-socialization, but also with effective criminal sanctions. In order to counter the trends, Croatia has also come to terms with contemporary legislation, by changing the Criminal Code, which sanctioned the most serious injuries and threats to the society, while in minor offenses we have misdemeanor legislation that has come the most to expression in this kind of law area. The aim of this paper is to explore the legislative mechanisms of the Republic of Croatia in the field of drug abuse prevention, the latest changes in the area, the views of the Croatian judiciary and to give my own opinion on this issue.
