Abstract
Zajednički zločnački pothvat konstruiran je od strane MKSJ kao institut koji bi trebao poslužiti kao osnova odgovornosti za kažnjavanje počinitelja ali i odgovornih osoba za najveće zločine počinjene u ratu od 1991. godine s prostora bivše Jugoslavije. Prvi put se koristi u presudi Suda u predmetu Tadiću. Stvaranjem širokih kriterija odgovornosti pod ovaj institut podvrgnuta je većina haških osuđenika. Osim osnovnog i sistemskog oblika po toj presudi postoji i prošireni oblik ZZP koji je najkritiziraniji zbog vrlo širokog opsega odgovornosti predviđanjem moguće posljedice nekog drugog kaznenog djela. Pluralitet osoba, zajednički plan i sudjelovanje optuženika u ostvarenju zajedničkog plana temelj su objektivnog kriterija odgovornosti (actus reus). Krivnja (mens rea) temelj je subjektivnom kriteriju odgovornosti. ZZP je model individualne odgovornosti za masovna kaznena djela koja obuhvaća i ona djela za koja nadređeni nije znao ali ih je mogao predvidjeti.
Abstract (english)
Joint criminal enterprise has been constructed by ICTY as an institute which should be foundation of responsibility for punishing offenders but also for punishing other responsible persons in the worst crimes made druring the War in Yugoslavia since 1991. First time is used in verdict of subject Tadić. By creating wide criterias od responsibility, great number of sentences have been verdicted on this base. Except of basic and systemic model of joint criminal enterprise there is also and extended type which is also among the most criticized legal terms because of the wide scale of responsibility by predicting possible consequences of some other crime. Plurality of persons, common plan and joint enterprise of all participants in common plan is actus reus. Quilty is foundation for mens rea. JCE is model of individual responsibility for massive crimes which also contains the responsibility for those crimes for which superior didn't know but he could predict them.
