Abstract
Tema ovog završnog rada je Konvencija za zaštitu ljudskih prava i temeljnih sloboda. Cilj je istražiti povijesni razvoj same Konvencije za zaštitu ljudskih prava i temeljnih sloboda, njezinu strukturu, istražiti prava koja propisuje i temeljne slobode i prava koja pruža, te Konvencijski nadzorni sustav. Nadalje, pobliže se upoznati s Konvencijskim protokolima s posebnim osvrtom na Protokol br. 13 o ukidanju smrtne kazne u svim okolnostima, te Protokol br. 11 i br. 14. Svakako se treba ukazati i na izuzetnu važnost Europskog suda za ljudska prava, način njegova funkcioniranja i rada, te utjecaj Konvencije na prava država članica, ali i utjecaj na sam pravni sustav Republike Hrvatske. Sve su to instrumenti kojima će se ukazati na samu važnost Konvencije kao najvažnijeg dokumenta za zaštitu ljudskih prava i temeljnih sloboda, ali i samu važnost Europskog suda koji postaje kreator europskih ustavnih standarda.
Abstract (english)
The theme of this final paper is the Convention for the Protection of Human Rights and Fundamental Freedoms. The aim is to explore the historical development of the Convention for the Protection of Human Rights and Fundamental Freedoms, its structure , prescribed rights, fundamental freedoms and rights that it provides, as well as a conventional surveillance system. Further, get familiar with convection protocols with a specialfocus on Protocol No. 13 concerning the abolition of the death penalty in all circumstances and Protocol No. 11 and No 14. Ofcourse, the European Court of Human Rights is of the utmost importance, the way of its functioning, and the impact of the Convention on the rights of member states, but also the impact on the legal system of the Republic of Croatia itself. All these are instruments that will point to the Convention as the most important document for the protection of human rights and fundamental freedoms, but also to the importance of the European Court which becomes the creator of European constitutional standards.
