Abstract
Zaštita ovršenika u ovršnom postupku jedan je od najbitnijih problema koji se pokušava riješiti posljednjim izmjenama i dopunama Ovršnog zakona. Cilj ovog rada je analizirati razvoj načela zaštite ovršenika u ovršnom postupku u Republici Hrvatskoj. Kao temeljni izvor analize zaštite ovršenika korišten je zakonodavni okvir kojim je u prethodnim razdobljima, kao i trenutno, regulirana ovrha u Republici Hrvatskoj. U tom kontekstu u radu je sadržana analiza instituta zaštite ovršenika od Zakona o izvršnom postupku, pa sve do Ovršnog zakona iz 2012. godine. U prvom dijelu rada u kratkim crtama definirani su ovršni postupak i stranke ovršnog postupka. U drugom dijelu rada prikazani su instituti zaštite ovršenika u Zakonu o izvršnom postupku kako bi se dobila cjelovita slika razvoja navedenih instituta u Republici Hrvatskoj. Potom slijedi analiza instituta zaštite ovršenika iz Ovršnog zakona iz 1996. godine i usporedba njihovog razvoja od Zakona o izvršnom postupku. U četvrtom dijelu sadržani su instituti zaštite ovršenika iz Ovršnog zakona iz 2012. godine, zaključno sa Zakonom o izmjenama i dopunama Ovršnog zakona iz 2017. godine. Konačno, u zaključnom dijelu sadržano je autorovo osobno mišljenje o razvoju zaštite ovršenika, njegovim uzrocima, i smjeru u kojem ono ide.
Abstract (english)
The protection of the debtor in enforcement proceedings is one of the most important problems that is being solved by the latest amendments to the Execution Act. The aim of this paper is to analyze the development of the principle of protection of debtor in enforcement proceedings in the Republic of Croatia. Legislative framework in the previous periods, as well as the current regulation of enforcement in the Republic of Croatia, was used as a basic source of analysis of the protection of debtor. In this context, the paper contains an analysis of the protection of the debtor since the Law on Execution Procedure, up to the Execution Act from 2012. In the first part of the paper, the enforcement procedure and the enforcement proceedings parties are defined. In the second part of the paper, the institutes of protection of the debtor in enforcement proceedings are presented in the Law on Execution Procedure, in order to obtain a complete picture of the development of the mentioned institutes in the Republic of Croatia. An analysis of protection of the debtor in enforcement proceedings from the Execution Act of 1996 and a comparison of their development from the Law on Execution Procedure is presented subsequently. The fourth part is composed of the institutes of protection of the debtor in enforcement proceedings from the Execution Act of 2012, concluding with the Act amending Execution Act of 2017. The final part of the paper contains the author's personal opinion on the development of the protection of the debtor in enforcement proceedings, its causes and the future direction.
