Abstract
Nasljedno pravo je ovlaštenje neke osobe da stupi u građansko pravne odnose umrloga. Nasljedno pravo se sastoji od dva dijela, a to su zakonsko nasljedno pravo i oporučno nasljedno pravo. Unutar zakonskog nasljednog prava postoji nužno nasljedno pravo. Nužno nasljedno pravo je skup pravnih pravila kojima se određuje krug osoba kojima je oporučitelj dužan ostaviti određeni dio svoje imovine. Pravo nužnog nasljednika definirano je u Zakonu o nasljeđivanju. Nužno nasljedstvo svoje korijenje vuče... More još iz rimskog prava, ali je bilo drugačije nazvano i definirano. Postoje apsolutni i relativni nužni nasljednici, a razlikuju se prema redu nasljeđivanja. Također, bitna razlika među njima je i dio ostavine koji dobivaju. Za apsolutne nužne nasljednike on iznosi ½ zakonskog dijela, a za relativne nužne nasljednike iznosi 1/3 zakonskog dijela. Nužne nasljednike je moguće isključiti iz ostavine ili ih lišiti njihovog nužnog dijela prema striktnim propisima nasljednog prava. Jasno je definirano što sve ulazi u ostavinu, odnosno u ostavinsku aktivu i pasivu. Da bi se izračunala čista vrijednost ostavine, potrebno je od aktive oduzeti pasivu. Sud nikad ne pazi na nužne nasljednike po službenoj dužnosti, nego oni moraju podnijeti zahtjev u obliku tužbe. Svoja prava ostvaruju u parničnom postupku. Na kraju rada, možemo vidjeti upotrebu instituta nužnog nasljednika na stvarnom predmetu i postupak koji se vodi kada nužni nasljednici nisu namireni u ostavinskom postupku. Less
Abstract (english)
The inheritance right is the legal authorisation of a person to enter into the civil/legal relations of the deceased. The inheritance law consists of two parts which are the statutory inheritance law and the inheritance law of will . Within the statutary inheritance law there is a forced heirs inheritance right. A forced heirs inheritance right is a set of legal rules that define the persons to whom the testator is obliged to leave a certain part of his/her property. The right of the forced... More heir is defined by the Succession Act. The forced inheritance is derived from the Roman law, but it was then called and defined differently. There are absolute and relative forced heirs and they are differed according to the order of succession. Another important difference between them is a share of the assets they get. For the absolute forced heirs it amounts to ½ of the legal share, and for the relative forced heirs it amounts to 1/3 of the legal share. Forced heirs can be excluded from inheritance or deprived of their reserved share by strictly defined rules of inheritance law. It is clearly defined what items form inheritance, that is, the assets and liability. In order to calculate the exact value of the assets it is necessary to deduct the liability from the assets. The court never takes into account the forced heirs by official duty. They have to file a claim in the form of a lawsuit. They exercise their rights in civil proceedings. At the end of the paper we can see a real case study concerning the forced heirs when their rights during the process have not been settled in the inheritance proceedings. Less
