Abstract
Brak je bitan obiteljskopravni institut koji za sebe veže određene učinke. Ono je vezano uz čovječanstvo od njegovih početaka. Institut braka se kroz povijest razvijao i mijenjao te danas u svijetu postoji nekoliko različitih vrsta obiteljskih zajednica i braka. U Republici Hrvatskoj postoji dvije vrste braka, brak u građanskom obliku i brak u vjerskom obliku s građanskopravnim učincima. Svaki od ta dva obliku su regulirana različitim propisima, Obiteljskim zakonom i Zakonikom kanonskog prava. Svaki od njih propisuje određene pretpostavke i uvjete koji moraju biti ispunjeni kako bi se brak mogao sklopiti, obiteljskopravne učinke braka te način na koji brak može prestati, kao i postupak te nadležnost vlasti za sve bračne sporove, ovisno o tome u kojem je obliku brak sklopljen i o vrsti spora. Predmet ovog rada je proučavanje i usporedba svakog od ta dva oblika, njihova međusobna povezanost, kao i statistika sklopljenih i razvedenih građanskih, tj. ništavih crkvenih brakova u Republici Hrvatskoj.
Abstract (english)
Marriage is a familial and legal institution that carries certain effects. It has been connected to humanity since its beginnings. The institution of marriage has been developing and changing through history and there are several different kinds of familial communities and marriages. In the Republic of Croatia there are two kinds of marriages, marriage in the civil form and marriage in the religious form with civil effects. Each of those two forms is regulated by different regulations, The Family Act and Canon Law. Each of them prescribes certain presumptions and conditions that must be fulfilled in order for the marriage to be possible, legal effects of the marriage, the way for the marriage to end, and a procedure and jurisdiction of authority for all marital disputes depending on the form of marriage and the kind of dispute. The subject of this paper is to examine and compare the two forms of marriage, their mutual connection and the statistics of civil marriages and divorces or annulled religious marriages in the Republic of Croatia.
