Abstract
Često smo svjedoci pogrešaka u pravomoćnim sudskim odlukama u kaznenom postupku koje, usprkos nastojanjima da se izbjegnu, nisu isključene. U svakom sustavu kaznenog postupka neophodno je predvidjeti iznimne slučajeve u kojima će biti moguće otkloniti određene nedostatke u pravomoćnim sudskim odlukama, a kao jedan od tih načina svakako je izvanredni pravni lijek obnova kaznenog postupka o kojem sam pisao u svom radu. U prvom dijelu svog rada pisao sam općenito o izvanrednim pravnim lijekovima i o obnavljanju kaznenog postupka, te istaknuo razlike između prave i neprave obnove kaznenog postupka. Nadalje, glavni dio rada odnosi se na analiziranje neprave i prave obnove kaznenog postupka po pojedinim odredbama Zakona o kaznenom postupku, što sam potkrijepio brojnim primjerima iz sudske prakse.
Abstract (english)
We are often witnesses of legal errors made in final court rulings in criminal proceedings, which, in spite of strenuous efforts to be avoided, nevertheless, cannot be excluded. In every system of criminal proceedings is necessary to predict extreme cases, in which it will be possible to rectify certain flaws in final court decisions, and one of the ways of rectification of flawed court decisions is certainly the use of extraordinary legal remedy - reopening of criminal proceedings, on which I have elaborated in my final paper. In the first part of my final paper I have discussed extraordinary legal remedy and reopening of criminal proceedings in general terms and have pointed out differences between the standard and extraordinary reopening of criminal proceedings. Moreover, the main body of the thesis refers to analysing standard and extraordinary reopening of criminal proceedings under specific provisions of the Act on Criminal Procedure, which I have supported by numerous case study examples.
