Abstract
Autor prije svega u radu obrađuje institut posjeda - pojam, vrste i pitanje zašto se posjed uopće štiti. No, da bi se mogla ostvariti njegova zaštita, mora doći do samovlasnog smetanja. S obzirom na važnost tih pojmova, u nastavku teksta će biti prikazana njihova detaljnija obrada. Pravo na zaštitu posjeda se u našem pravnom poretku ostvaruje na načine koji su propisani Zakonom o vlasništvu i drugim stvarnim pravima. Međutim, posjed se može zaštititi i drugim pravnim sredstvima. S obzirom da zaštita posjeda potječe još iz rimskog prava, ukratko se navode vrste posjeda kojima se pružala takva zaštita te sredstva koja su služila takvoj zaštiti - interdikti. Sudska zaštita predstavlja prvenstven način pružanja posjedovne zaštite, pa se ona u radu detaljnije analizira kroz pitanje tko ima pravo na zaštitu, koji su sastojci tužbe zbog smetanja posjeda i rješenja o smetanju posjeda te pitanje provedbe tog rješenja, uz navođenje slučajeva iz novije sudske prakse. Osim putem suda, Zakon o vlasništvu i drugim stvarnim pravima dopušta zaštitu posjeda uporabom vlastite sile - tzv. samopomoć. U radu se navode koji uvjeti moraju biti ispunjeni za takvu vrstu zaštite, te se daje odgovor na pitanje o dopuštenosti sudske zaštite nakon što je posjednik djelomično uspostavio ranije posjedovno stanje putem samopomoći.
Abstract (english)
The author primarily elaborates the institute of possession - term, types and the question why do we protect possession. In order to be able to protect possession, there must be an act of trespassing. This term will be further analyzed in the paper. The right to protection is regulated by the Law on Ownership and Other Real Rights. Also, possession can be protected by other legal institutes. Since protection of possession comes from Ancient Roman law, the paper elaborates the types of possession which were protected and the legal institutes that used to give such protection - interdict. Judicial protection is the primary way of providing it, so it is more thoroughly analyzed in the work through questions who is entitled to it, the substance of the lawsuit and court decisions, and questions about enforcement of that court decisions - all accompanied by examples of recent case-law. Apart from the protection trough court, the Law on Ownership and Other Real Rights permits the protection by force - the so called self-protection. The paper also elaborates which legal conditions have to be fulfilled for a such type of protection and possibility of a combination with judicial protection once the previous possession is established partially by self-protection.
