Abstract
This paper overwies interim measure security for costs as a neglected and forgotten institute which is in times of EU loosing its purpose. Through three different units paper reviews legislation of Republic of Croatia envolving this matter and its case law that is answering and explaining all the questions left blank; different variants of this institute in different countries of the European continent but of the different legal systems and security for costs in international arbitration, especially commercial arbitration proceedings which is in practice rather different than in civil law procedures.
Abstract (croatian)
U ovom radu prikazana je problematika instituta osiguranja parničnih troškova, tj. aktorske kaucije koja je po mnogočemu zaboravljeni i zanemareni institut koji svakako u vrijeme Europske unije gubi svoju primarnu svrhu. Kroz tri odvojene cjeline u radu je prikazano zakonodavstvo Republike Hrvatske koje uređuje ovaj pojam te praksa hrvatskih sudova koja istu nadopunjuje i pojašnjava; različite varijacije ovog instituta prihvaćene u različitim zemljama europskog kontinenta ali drugog pravnog sistema; te aktorska kaucija u procesima međunarodne arbitraže, osobito trgovačke, koja je u svojoj primjeni u potpunosti drugačija nego u građanskim procesima.
