Abstract
Tema ovog diplomskog rada je izmjena ili raskid ugovora zbog nemogućnosti ispunjenja uzrokovanih pandemijom Covid-19. Raskid ugovora je jedan od načina prestanka obvezno pravnog odnosa. Može biti raskid na temelju stranačke volje ili na temelju zakona. Na osnovi zakona razlikujemo jednostrani raskid i raskid ex lege. Do jednostranog raskida dolazi zbog neispunjenja i zbog promijenjenih okolnosti. Raskid zbog promijenjenih okolnosti temelji se na kaluzuli rebus sic stantibus koja odstupa od načela pacta sunt servanda i ublažava djelovanje te klauzule. Kako bi se klauzula rebus sic stantibus mogla primijeniti potrebno je da se ispune određene pretpostavke a to su: izvanrednost, nepredvidivost, naplativost i promjena okoline. Pandemija Covid-19 ostavila je posljedice na ugovore i njihovo izvršenje a s obzirom da na cjelokupnu situaciju nitko nije bio pripremljen, ostavlja se prostor za iznimke od postojećih pravila.
Abstract (english)
The subject of this thesis is contract modification or dissolution due to the impossibility of fulfilling the contract caused by the Covid-19 pandemic. Contract termination is one of the ways of discontinuation of mandatory law relation. Termination can happen on the behalf of the will of the parties or can be based on the law. Based on the law, there are unilateral termination and ex lege termination. Unilateral termination occurs due to non-fulfillment of the contract and due to changed circumstances. Termination due to changed circumstances is based on the caluzula rebus sic stantibus which deviates from the principle pacta sunt servanda and mitigates the effect of that clause. In order for the clause rebus sic stantibus to be applied it is necessary to fulfill certain conditions which are: extraordinary, unpredictability, collectability and change of the environment. The Covid-19 pandemic had left consequences on contracts and their execution and while considering that no one was prepared for the entire situation there is space for exceptions to the existing rules.
