Abstract
This thesis focuses on the position of different creditors in Croatian and comparative related legal systems. In the first half of the thesis, the focus will be on the definition of separation right, the basis of its occurrence and the rights and obligations arising from the aforementioned relationship. Next, all creditors in pre-bankruptcy and bankruptcy proceedings will be listed with special emphasis on the separate creditor, his legal position, the registration of claims in the bankruptcy estate, the position in the sale of assets of the bankruptcy debtor as a whole, the convening of the creditors' assembly, the sale of items in which there is a separation right through a public auction and the settlement of the separate creditor, the right of set-off at the public auction, the obligation of the separate creditor to participate in the costs of bankruptcy proceedings.
Abstract (croatian)
Ovaj rad se fokusira na položaj razlučnog vjerovnika u hrvatskom i poredbenim srodnim pravnim porecima. U prvoj polovici rada u fokusu će se naći definicija razlučnog prava, osnove nastanka istog te prava i obveze koje proizlaze iz spomenutog odnosa. Zatim će se navesti svi vjerovnici u predstečajnom i stečajnom postupku sa posebnim naglaskom na razlučnog vjerovnika, njegov pravni položaj, prijava tražbine u stečajnu masu, položaj kod prodaje imovine stečajnog dužnika kao cjeline, sazivanje skupštine vjerovnika, prodaja predmeta na kojima postoji razlučno pravo putem javne dražbe te namirenje razlučnog vjerovnika, pravo prijeboja kod javne dražbe, obvezu razlučnog vjerovnika da participira u troškovima stečajnog postupka.
