In one interview, Edward Snowden stated: “Arguing that you don't care about the right to privacy because you have nothing to hide is no different than saying you don't care about freedom of speech because you have nothing to say or freedom of the press because you have nothing to write.” On the one hand, it seems like democracy has provided us with never more comprehensive catalogue of rights and freedoms, but on the other hand it seems like intrusions into the private sphere of individuals have never been easier to achieve. However, it is not only the state that can infringe one’s personality rights through the surveillance systems, but this can also be done by mass media and by private individuals and groups. With huge amount of articles and data being published every minute in the newspapers or elsewhere, making it available to great number of people, it is not unusual that false, misleading or strictly personal information on one’s persona is disseminated. This paper tackles the issue of violation of personality rights in substantive law and in European private international law in particular. The main objective is to provide the reader with the legal background of personality rights in Croatia and in Europe with emphasis on disputes having connection with more than one country. In order to achieve this, an overview of the instruments of legal protection of these rights on international, European and Croatian national levels is presented. However, focus of the paper is on the European Union law, namely the regulations on international jurisdiction and applicable law and relevant case law.
