Abstract
U okviru zakonskih propisa, prikazuje se odgovornost za neispravan proizvod kao specifična potkategorija općeg instituta odgovornosti za štetu. Definiraju se različite uloge i subjekti koji su uključeni u ovu vrstu odgovornosti, uključujući proizvođača, oštećenika, pojam proizvoda, specifične vrste proizvoda i posebno neispravan proizvod. Rad detaljno analizira pretpostavke koje moraju biti ispunjene kako bi se ostvarila ova vrsta odgovornosti, s naglaskom na specifičnosti same institucije odgovornosti za štetu. Istaknut je i Američki pristup institutu odgovornosti za neispravan proizvod s ciljem ostvarivanja usporedbe i isticanja različitosti u odnosu na sustav kakav susrećemo u Republici Hrvatskoj. Navode se i primjeri iz domaće sudske prakse kako bi se potkrijepili teorijski izneseni koncepti o ovoj instituciji odgovornosti za štetu.
Abstract (english)
It is demonstrated through legal regulations that liability for a defective product is a subtype of the general concept of liability for damages, defining who is considered a manufacturer, a victim, what constitutes a product, specific types of products, and specifically a defective product. The paper elaborates on the assumptions that must be fulfilled for the occurrence of this type of liability, which are unique to this particular concept of liability for damages. The rules governing liability for a defective product are briefly presented in comparison with those regulating other types of liability, thereby clarifying the rationale behind the special regulation of this form of liability. The American approach to the institute of liability for a defective product was also highlighted, with the aim of comparing and emphasizing the differences in relation to the system we encounter in the Republic of Croatia. Several cases from domestic jurisprudence are cited, providing empirical support for the theoretical concepts presented regarding this concept of liability for damages.
