Abstract
U ovom diplomskom radu pristupa se slobodi kretanja radnika unutar Europske Unije (dalje: EU) kao jednoj od temeljnih tržišnih sloboda u ostvarivanju ciljeva integracije EU. Tržišne slobode dijele se na slobodu kretanja roba, ljudi, kapitala i usluga kao supsidijarne tržišne slobode. U literaturi se kao peta tržišna sloboda navodi i građanstvo EU, koja izaziva nejasnoće jer su tržišne slobode navedene Ugovorom o funkcioniranju Europske Unije. Kako iz njih proizlaze subjektivna prava, zavisno od... More činjeničnog stanja pojedinog slučaja, odnos između temeljnih sloboda i prava može djelovati na način obrnutih ograničenja. Unatoč brojnim pogodnostima u ostvarenju imperativa unutranjeg tržišta u državama podrijetla i državama primateljicama, provedba slobode kretanja radnika suprostavljena je i negativnom kretanju socijane politike u odnosu na države članice, kao i na nizak postotak mobilnosti radne snage. Glavna struktura pravne osnove zasniva se na čl. 45.-48. Ugovora o funkcioniranju Europske Unije, Uredbi o slobodi kretanja radnika 492/2011, Direktivi o slobodi kretanja radnika 2014/54/EU i Direktivi 2004/38/EZ o pravu građana Unije i članova njihovih obitelji na slobodno kretanje i boravište na području država članica. U analizi slobode kretanja radnika poseban značaj imaju presude Europskog suda kao izvora europskog prava koji pokazuje utjecaj njegove prakse na smjer i učinak djelovanja pravnih normi u razumijevanju prava i opravdanih ograničenja u njihovom ostvarenju. Abstract (english)
This thesis addresses the freedom of movement of workers within the European Union (hereinafter: the EU) as one of the fundamental market freedoms in attaining the goals of EU integration. Market freedoms include freedom of movement of goods, people, capital, and services as subsidiary market freedoms. EU citizenship is mentioned in literature as a fifth market freedom, which creates confusion, because market freedoms are listed in the Treaty on the Functioning of the European Union. As... More subjective rights arise from those, depending on the factual situation of an individual case, the relationship between the fundamental freedoms and rights can act in the manner of reverse restrictions. Despite the many benefits in realizing the imperative of the internal market in the countries of origin and the receiving countries, implementation of the freedom of movement of workers is also in contrast to the negative trend of social policy in relation to the member states, as well as to the low percentage of labor force mobility. The main structure of the legal basis is based on Articles 45-48 of the Treaty on the Functioning of the European Union , Regulation 492/2011 on freedom of movement for workers, Directive 2014/54/EU on freedom of movement of workers, and Directive 2004/38/EC on the right of citizens of the Union and their family members to free movement and residence in the territory of the member states. In the analysis of the freedom of movement of workers, judgments made by the European Court are of particular importance as a source of European law that displays the influence of its practice on the direction and effect of the impact of legal norms in the understanding of rights and justified limitations in the exercising of those rights.
