Abstract
Šerijatsko pravo je radikalna projekcija Islama i sastoji se od niza pravila, običaja i obveza koje se razlikuju od svega onoga čemu trebamo težiti u razvijenim, demokratskim i suvremenim državama. Posebno radikalne odredbe Šerijatskog prava one su koje se tiču žena i njihovih prava. Iako potupno neprimjeren Šerijat se poštuje u brojnim zemljama i danas. Katar, Iran, Pakistan, Irak i Jemen samo su neke od njih. Izvori Šerijata zapravo su izvori Islama, koji se primjenjuju i shvaćaju doslovno i radikalno, a to su : Ku’ran, Suna, Idžma i Kijas. Islam, iako strog i vrlo precizan nije isto što i Šerijat koji se nije promijenio niti prilagodio današnjici sve od vremena kada je nastao do danas. Ključno obilježje Šerijata, ujedno i tema ovog rada je položaj žena šerijatu u odnosu na muškarce, njihova podređenost i kršenje njihovih osnovnih ljudskih prava i sloboda svakodnevno, od rođenja i položaja u obitelji do podređenosti u svakom drugom aspektu postojanja i djelovanja.
Abstract (english)
Shariah is the fundamental religious concept of Islam, which consists of a range of rules, customs and obligations that differ from everything that we should strive for in developed, democratic and modern societies. Especially radical are those parts of Shariah that concern women and their rights. Although it is completely inappropriate, Shariah is respected in many countries today. Qatar, Iran, Pakistan, Iraq and Yemen are just some of them. Shariah origins are in fact the origins of Islam that are applied and understood literally and radically and these are Quran, Sunnah, Ijma and Qiyas. Although Islam is strict and precise it is different from Shariah, which hasn't changed or adapted with time ever since its creation. The key characteristic od Shariah, which is also the topic of this piece of work, is the subordinate position of women in relation to men and the violation of their fundamental rights and freedoms, from their birth and position in the family to being subordinate in every other aspect of their life.
