Abstract
U novije vrijeme, značajnu temu predstavlja ''Right to disconnect'' ili u prijevodu pravo na odspojiti se. Drastičnim porastom obavljanja rada na daljinu, a naročito pojavom pandemije koronavirusa porastao je postotak radnika koji svoj posao obavljaju od kuće i suočavaju se s brojnim pozitivnim i negativnim posljedicama koje nastaju. Rad na daljinu rezultirao je dobrim stranama; veća sloboda i fleksibilnost u obavljanju posla, ali je doveo i do neizbježnih problema s mentalnim i fizičkim zdravljem zaposlenika te manjkom privatnosti i slobodnog vremena. Posljedično se počela brisati granica između poslovnog i privatnog života te se pojavila potreba za rješavanjem konkretne problematike. Prvi znakovi reguliranja prekovremenog rada i rada na daljinu pojavili su se u Francuskoj 2017. godine, a time su potaknute i ostale europske države koje su učinile isto ili su još uvijek u pregovorima o potencijalnoj regulaciji. Pravo na odspojiti se je upravo sustav koji nastoji umanjiti štetne posljedice prekovremenog rada i stvoriti pravilnu ravnotežu koja bi kreirala odgovarajući okvir radnog vremena te stvoriti konkretno pravno sredstvo koje bi se implementiralo na sve države.
Abstract (english)
In recent times, the ''Right to disconnect'' has become an increasingly relevant topic. With an exponential increase in teleworking, and especially with the emergence of the Coronavirus pandemic, there has been an increase in the share of employees working from home, facing both positive and negative resulting consequences. Teleworking has resulted in certain positive aspects; greater freedom and flexibility in doing work. However, it also led to inevitable problems regarding the employees' mental and physical health, as well as lack of privacy and leisure time. As a consequence, the line between bussines and private life started disappearing, leading to a need to address these specific issues. The first signs of overtime and teleworking regulation appeared in France in 2017., prompting other European countries which have either done the same or are still conducting negotiations for potential regulation. The right to disconnect is precisely a system that seeks to reduce the harmful effects of overtime working and establish the right balance that would create an appropriate working time framework, as well as a concrete legal remedy that could be implemented in all countries.
