Abstract
Jedna od najvažnijih novina koje je zakonodavac unio 1996.godine u hrvatsko stečajno pravo je upravo institut stečajnog plana.U okviru stečajnog postupka,stečajnim planom je dopušteno odstupiti od zakonskih odredbi o raspodjeli i unovčenju stečajne mase, kako bi se omogućilo stečajnom dužniku restrukturiranje, nastavak poslovanja i opstanak. Ovaj rad će detaljnije objasniti što je pojam stečajnog plana,na koji način se provodi,uz primjere iz sudske prakse, te detaljnije primjere slučajeva restrukturiranja trgovačkog društva Pevec d.d. te dubrovačke hotelske tvrtke Belvedere.
Abstract (english)
One of the most important innovations that the legislator introduced into Croatian bankruptcy law in 1996 is the institute of the restructuring plan. Within the bankruptcy procedure, the restructuring plan is allowed to deviate from the legal provisions on the distribution and liquidation of the bankruptcy estate in order to enable the bankruptcy debtor to restructure, continue to operate and survive. This paper will explain in more detail what the concept of a restructuring plan is, how it is implemented, with examples from case law, and more detailed examples of cases Pevec company restructuring and Belvedere hotel company.
