Abstract
Kaznenim zakonom propisana su kaznena djela protiv čovječnosti i protiv ljudskoga dostojanstva. Naime, njihova kompleksnost sadržana je u Glavi IX. Kaznenog zakona Republike Hrvatske, odnosno u prvoj Glavi posebnog dijela Kaznenog zakona, čime je interpretirana njihova važnost u okviru kaznenopravne zaštite. Općenito, kaznena djela u Glavi IX. podijeljena su u tri skupine: ratni zločini, teroristička kaznena djela i kaznena djela kojima se vrijeđa ljudsko dostojanstvo. Međutim, fundamentalnu tematiku završnog rada čini skupina kaznenih djela koja pripadaju grupi ratnih zločina, tj. genocid, zločin protiv čovječnosti, zločin agresije, ratni zločin, povreda pregovarača, zlouporaba međunarodnih znakova, neopravdana odgoda povratka ratnih zarobljenika, novačenje plaćenika te odgovornost zapovjednika. Svako kazneno djelo detaljno će biti objašnjeno u radu te će se izvršiti usporedba kaznenih djela ratnih zločina, sukladno kaznenopravnom zakonodavstvu koje je do 2007. godine na snazi, kada su kaznena djela povezana s ratnim zločinom bila dijelom Glave XIII., naslovljene: Kaznena djela protiv vrijednosti zaštićenih međunarodnim pravom. Takav Kazneni zakon bio je važeći do 1. siječnja 2013. godine. Od 2013. godine Kazneni zakon Republike Hrvatske doživljava brojne zakonske promjene, modernizira se te usklađuje s važećim međunarodnim dokumentima. Ujedno, završni dio rada donosi usporedbu definicije ratnog zločina s propisima Međunarodnoga kaznenog suda (stalnoga).
Abstract (english)
The Criminal Code prescribes criminal offenses against humanity and human dignity. Namely, their complexity is contained in Section IX. Croatian Criminal Code, or the 1st chapter of the special part of the Criminal Code, which is interpreted their significance in the context of legal protection. Generally, offenses in Title IX. divided into three groups: war crimes, terrorist crimes and offenses that are offensive to human dignity. However, the fundamental theme of the dissertation consists of a group of criminal acts that belong to the group of war crimes, namely genocide, crimes against humanity, crimes of aggression, war crimes, Violation negotiator, Misuse of international symbols, Unjustified delay the return of prisoners of war, recruiting mercenaries and Responsibility commander. Any offense will be explained in detail in the work and will make comparison of war crimes in accordance with the criminal justice legislation that was in force in 2007 when the offenses related to the war crime was part of Title XIII. entitled Criminal offenses against values protected by international law. Such Criminal Code was valid until 1 January 2013. Since 2013, the Croatian Criminal Code experiencing numerous legislative changes, modernize it and coordinate with the relevant international documents. At the same time, the final part of the work brings a comparison of the definition of war crime with the regulations of the (permanent) International Criminal Court.
