Abstract
Djeca, u kontekstu ovog diplomskog rada, su sve one maloljetne osobe mlađe od četrnaest godina, zatim maloljetnici do osamnaeste godine života koje dijelimo u dvije skupine, a to su mlađi maloljetnici i stariji maloljetnici. Osim toga, rad se također bavi kategorijom mlađih punoljetnih osoba koja podrazumijeva sve one osobe koje su navršile osamnaest godina, ali nisu stariji od dvadeset i jedne godine života. Kada neka od gore navedene djece i starijih osoba počini kakvo kažnjivo ili prekršajno djelo, bit će primjenjivane odredbe različitih zakona koji se odnose na maloljetnike. Zakoni i konvencije koje propisuju prava maloljetnika u situacijama kada se nađu pred nadležnim tijelima, neovisno o tome u kojem svojstvu se u postupku nalaze jesu: Ustav Republike Hrvatske, Zakon o sudovima za mladež, Zakon o izvršavanju sankcija izrečenih maloljetnicima za kaznena djela i prekršaje te međunarodni izvor prava djece - Konvencija o pravima djeteta. Kod uvođenja u temu ovog rada definiraju se problemi u ponašanju djece, pojam maloljetničke delinkvencije te važnost centra za socijalnu skrb, čija uloga pridonosi razvitku pravnog okvira u korist maloljetnih lica, ali i djelovanje socijalne skrbi u onim situacijama kada je potrebno organizirati, provesti i nadzirati izvršavanje od strane suda izrečenih mjera i sankcija.
Abstract (english)
In the context of this master thesis, children are considered to be all minors under the age of fourteen and then minors under the age of eighteen, which we divide into two groups, younger minors and older minors. In addition, the thesis is considering a category for young adults who are older than eighteen years of age but not older than twenty one. When one of the above individuals commits a criminal offense or misdemeanor, the provisions of various laws regarding minors will apply to them. The laws and conventions that define the rights of minors, when facing competent authorities, regardless of the capacity in which they are proceeding, are: The Constitution od the Republic of Croatia, the Juvenile Courts Act, the Act on Enforcement of Sanctions for Criminal and Minor Offences against Minors and international source of children's rights - the Convention on the Rights of the Child. While addressing this topic, it is imperative to define antisocial behavior in childen, the juvenile delinquency and the importance of the Child Protective Services, whose purpose is developing the legal framework in favor of minors, in addition to acting in situations when it is necessary to organize, implement and supervise the execution of measures and sanctions imposed by the court.
