Abstract
Ovaj rad bavi se problematikom vezanom uz zaštitu djece s teškoćama u razvoju. Nakon definiranja temeljnih pojmova donosi se povijesni kontekst odnosa društva prema djeci s teškoćama u razvoju te se donosi pravni okvir potreban za uspostavljanje zakonske regulative s ciljem zaštite prava djece s teškoćama. U središnjem dijelu rada analizira se problematika prava djece s teškoćama u razvoju u sustavu socijalne i zdravstvene skrbi i sustavu odgoja i obrazovanja te se problematizira o kršenju prava djece s teškoćama u razvoju kao i o njihovim pravima u vrijeme pandemije COVID-19. Sustavi socijalne skrbi, zdravstva i obrazovanja predstavljaju sustave od posebnog značaja za inkluziju djece s teškoćama. Uvidom u dobivene informacije može se zaključiti kako je Republika Hrvatska učinila značajne korake za zaštitu djece s teškoćama u razvoju, međutim, zbog nedovoljno reguliranih zakonskih propisa i dalje se pronalaze načini da se prava djece s teškoćama u razvoju krše.
Abstract (english)
This thesis deals with issues related to the protection of children with developmental disabilities. After defining the basic terms, the historical context of society's relationship to children with developmental disabilities is presented as well as the legal framework necessary for the establishment of legal regulations aimed at protecting the rights of children with disabilities. In the central part of the paper, the issue of the rights of children with developmental disabilities in the social and health care system and the education system is analyzed, and the violation of the rights of children with developmental disabilities as well as their rights during the COVID-19 pandemic is discussed. The systems of social care, health and education represent systems of special importance for the inclusion of children with disabilities. Looking at the information obtained, it can be concluded that the Republic of Croatia has taken significant steps to protect children with developmental disabilities, however, due to insufficiently regulated legislation, ways are still being found to violate the rights of children with developmental disabilities.
