Abstract
Potreba za bržim i efikasnijim rješavanjem kaznenih predmeta dovela je do sve veće upotrebe pomoćnih sredstava u kriminalističkom istraživanju. Najzastupljeniji je poligraf koji se tijekom godina razvio do te mjere da se upotrebljava, barem u nekoj mjeri, u većini država svijeta. Poligrafskim se ispitivanjem u Republici Hrvatskoj ubrzao proces provjere vjerodostojnosti izjava koje su tijekom prikupljanja obavijesti dali građani, ali i provjere iskaza osumnjičenih osoba. Brojnim promjenama Zakona o kaznenom postupku uvodile su se i ukidale odredbe prema kojima policijski službenici mogu upotrebljavati poligrafsko ispitivanje kao dio istražnog procesa. Od novele Zakona iz 1997. pa do Zakona iz 2017. mijenjao se i status osumnjičenika i njegova prava, pa samim time i mogućnost upotrebe poligrafa. Implementacijom Europskih direktiva hrvatsko se zakonodavstvo približilo zakonodavstvima ostalih zemalja članica Europske Unije.
Abstract (english)
The need for faster and more effective resolution of criminal proceedings has led to an increasing use of investigative aids. The most common is the polygraph, which has developed over the years to such a degree that it is used, at least to some extent, in most countries of the world. The polygraph examination in the Republic of Croatia accelerated the process of verifying the authenticity of testimonies given by citizens during the collection of information, but also the verification of testimonies of suspects. Numerous amendments to the Criminal Procedure Code have introduced and repealed provisions under which police officers may use polygraph examinations as part of the investigation process. From the amendment to the 1997 Act to the 2017 Act, the status of the suspect and his/her rights changed, and thus the possibility of using a polygraph. With the implementation of European Directives, Croatian legislation has approached the legislation of other European Union member states.
