Abstract Morsko razbojništvo, odnosno piratstvo u suvremenom brodarstvu predstavljaju prijetnju za ljudske živote, njihovu imovinu, te općenito govoreći pomorsku plovidbu. Ono je regulirano različitim međunarodnim i nacionalnim pravilima kako bi se utvrdile pretpostavke, odnosno uvjeti koji bi morali biti ispunjeni da bi se uopće radilo o piratskom činu. Takav nezakoniti čin može se odvijati na otvorenom moru, a prema novijim shvaćanjima i na teritorijalnom, s obzirom da je većina počinjenih djela koja odgovaraju opisu piratstva, počinjeno baš u područjima koja se nalaze pod jurisdikcijom pojedine države. Sam čin piratstva počinjen je od strane putnika ili posade privatnog broda, odnosno zrakoplova, u osobne svrhe i zarad ostvarenja posebih ciljeva. Predstavlja zločin koji se nastoji suzbiti na način da se pojačaju mjere protiv piratstva i da kao takve budu praktične i davaju učinke u primjeni. Piratstvo dosta utječe na međunarodnu trgovinu, koja se većinom odvija preko mora i oceana, kao i na sigurnost samih pomoraca i osoba koje plove brodovima u područjima u kojima piratstvo buja. Kada govorimo o piratstvu kao međunarodnom zločinu, ono u tom smislu u postojećem međunarodnom pravu ne postoji, već ga definira interni zakon određene države, koja ima pravo kažnjavanja i progona kao obalna država. Brojne međunarodne organizacije na raznorazne načine pokušavaju stati na kraj piratstvu i iako je danas piratstvo svedeno na minimum, ono i dalje postoji. Od Konvencije o pravu mora i patroliranja brodova pod okriljem međunarodnih organizacija (NATO, EU i UN) pa do rezolucija i smjernica koje donose organizacije poput Međunarodne pomorske organizacije (IMO). Brojna su pitanja oko kojih se lome koplja kada je piratstvo u pitanju, počevši od same definicije piratstva pa sve do kažnjavanja pirata i oružane pratnje na brodovima, kao najučinkovitijeg načina sprečavanja pirata u ostvarenju njihovih ciljeva. U radu će biti opisan razvoj samog piratstva, njegov utjecaj na suvremeno pomorsko pravo, pravna regulacija i borba protiv piratstva, način na koji pojedine organizacije i države pokušavaju stati na kraj piratstvu, te najpoznatiji medijski primjeri piratstva, oni iz Adenskog i Gvinejskog zaljeva.
Abstract (english) Robbery or piracy in modern shipping is a threat to human lives, their property, and generally speaking, maritime navigation. It is regulated by various international and national rules in order to determine the preconditions or conditions that would have to be met in order for it to be a pirate act at all. Such an illegal act can take place on the high seas, and according to recent understandings on the territorial, since most of the acts committed that correspond to the description of piracy, were committed in areas under the jurisdiction of each state. The act of piracy itself was committed by a passanger or the crew of a pirate ship or aircraft,for personal purposes and for the purpose of achieving special goals. It is a crime that seeks to combat anti-piracy measures and, as such, to be practical and effective. Piracy has a major impact on international trade, which takes place mostly across the seas and oceans, as well as on the safety od seafarers and people on boats in areas where piracy is rampant. When we talk about piracy as international crime, in that sense it does not exist in the existing international law, but is defined by the internal law of a certain state, which has the right to punish and persecute as a coastal state. Numerous international organizations are trying to put an end to piracy in various ways, and although piracy has been reduced to a minimum today, it still exists. From the Convention on the Law of the Sea and the patrol of ships under the auspices of international organizations (NATO, EU and UN), to resolutions and guidelines issued by organizations such as the International Maritime Organization (IMO). There are many issues when it comes to piracy, from the very definition of piracy to punishing pirates and armed escorts on ships, as the most effective way to prevent pirates from achieving their goals. The thesis will decribe the development of piracy, its impact on modern maritime law, legal regulation and fight against piracy, the way some organizations and countries are trying to stop piracy, and the most famous media examples of piracy, those from the Gulf of Aden and Guinea
