Abstract Tema ovog završnog rada je „Istospolno partnerstvo u pravu EU“ koje je uređeno Zakonom o istospolnim zajednicama i Zakonom o životnom partnerstvu osoba istoga spola, te ima elemente u mnogim drugim zakonima, kao što je Obiteljski zakon, Zakon o medicinski potpomognutoj oplodnji, te (Europska) Konvencija za zaštitu ljudskih prava i temeljnih sloboda. Svrha pravnog poretka je ta da predstavlja prava osoba. Brak, definicija koja karakterizira zajednicu osoba različitoga spola, koja je definirana u samom Ustavu RH, u hrvatsko zakonodavstvo uveden je sasvim novi institut a to je životna zajednica osoba istoga spola. U posljednjih dvadesetak godina sve je veći broj istospolnih zajednica koji vode borbu pred zakonom za jednakošću u obiteljsko-pravnom statusu. U Republici Hrvatskoj iz godine u godinu raste broj istospolnih zajednica, ali taj broj je znatno manji u odnosu na europski prosjek. Povezanost braka i istospolnih zajednica je ta da se nastaju ali i prestaju na identičan način, a to je izjava volje pred nadležnim tijelom, tj. matičarom. Najveće posljedice snose djeca koja se nalaze u takvim zajednicama, zbog nepriznavanja istih, dok su ta ista prava dostupna djeci koja su u tzv. normalnim zajednicama. Kako su se zakoni uređivali i stupali na snagu, zakonodavac se založio da pravo međusobnog uzdržavanja treba biti uređen na isti način u svim zajednicama. Trenutno najprisutniji model životnih zajednica osoba istoga spola na razini Europske unije čini model registriranih parova, te ima istu osnovu brak ili izvanbračna zajednica, te im je na taj način omogućeno stjecanje određenih prava i obveza.
Abstract (english) The topic of this final paper is "Same-Sex Partnership in EU Law" which is regulated by the Law on Same-Sex Communities and the Law on Life Partnership of Persons of the Same Sex, and has elements in many other laws, such as Family Law, Medically Assisted Fertilization Law, and ( European) Convention for the Protection of Human Rights and Fundamental Freedoms. The purpose of the legal order is to represent the right person. Marriage, a definition that characterizes the community of persons of different sexes, which is defined in the Constitution of the Republic of Croatia, a completely new institute has been introduced into Croatian legislation, and that is the living community of persons of the same sex. In the last twenty years, an increasing number of same-sex communities have been fighting before the law for equality in family law status. In the Republic of Croatia, the number of same-sex unions is growing from year to year, but this number is significantly lower than the European average. The connection between marriage and same-sex unions is that they arise but also end in an identical way, and that is a declaration of will before the competent body, ie the registrar. The biggest consequences are borne by children who are in such communities, due to non-recognition of the same, while these same rights are available to children who are in the so-called. normal communities. As the laws were regulated and entered into force, the legislator advocated that the right of mutual maintenance should be regulated in the same way in all communities. Currently, the most present model of same-sex relationships at the level of the European Union is the model of registered couples, and has the same basis of marriage or cohabitation, thus enabling them to acquire certain rights and obligations.
