Abstract
Javna nabava važan je segment svakog suvremenog gospodarstva, a učinkovit sustav javnih nabava nužan je za postizanje ciljeva slobodnog tržišta i osiguranje uvjeta tržišnog natjecanja. Označava postupak u kojem javni naručitelj, koji samostalno ne stječe financijska sredstva nego je neposredan ili posredan korisnik državnog ili lokalnog proračuna, naručuje robe, usluge ili izvođenje radova od privatnih ponuditelja, što izravno povezuje javni i privatni sektor. Pravo javne nabave važan je dio pravnog sustava svake države. Postupcima javne nabave država osigurava obavljanje gotovo svih svojih javnih funkcija, nabavljajući robe, radove i usluge od važnosti za svoje djelovanje. Tako se javnom nabavom koristi značajan dio proračunskih sredstava države, te ona predstavlja velik dio državne potrošnje, ali i značajan dio opće gospodarske djelatnosti u svakoj državi. Provođenje procesa javne nabave Republika Hrvatska počela je s primjenom pravne stečevine EU s pristupnim pregovorima za prijem u članstvo EU. Upravljanje javnom nabavom radi nabave roba, radova i usluga u Republici Hrvatskoj, te pravna zaštita, regulirani su Zakonom o javnoj nabavi (NN 120/16).
Abstract (english)
Public procurement is an important segment of any modern economy, and an effective public procurement system is necessary to achieve free market goals and ensure conditions of competition. Denotes a procedure in which a contracting authority, which does not independently acquire financial resources but is a direct or indirect user of the state or local budget, orders goods, services or works from private bidders, which directly connects the public and private sectors. Public procurement law is an important part of every country's legal system. Through public procurement procedures, the state ensures the performance of almost all its public functions, procuring goods, works and services of importance for its activities. Thus, public procurement uses a significant part of the state budget, and it represents a large part of government spending, but also a significant part of general economic activity in each country.The implementation of the public procurement process The Republic of Croatia has started to apply the acquis communautaire with accession negotiations for EU membership. Management of public procurement for the procurement of goods, works and services in the Republic of Croatia, as well as legal protection, are regulated by the Public Procurement Act (OG 120/16).
