ABSTRACT The subject of this diploma thesis is a specific contract of obligatory law, the donation agreement. A seemingly unimportant contract in practice is a very common case, especially between close relatives. The legislator pays special attention to it by defining its purpose and essential characteristics by the provisions of the Civil Obligations Act, which is applied as a lex generalis, and this work will primarily be aimed at elaborating the directives of the aforementioned law in as much detail as possible. Since the subject of the contract is mostly real estate, which requires a written form of contract and the implementation of registration in the land register, which is necessary for the validity of the legal transaction, of crucial importance is the application of special laws which in this case appear as lex specialis. A written form of contract is also necessary for donation agreements without proper delivery of things. Also, special regulations regulate the tax obligations of the donee, as well as possible exemptions from the same. Since it is a free legal business and the donation is encouraged solely by the will and desire of the donor, the Law on Obligations regulates when the donor may withdraw from the donation as well as the justified reasons for which he may revoke his donation. The aim of this paper is to present the importance and application of the said contract in the best possible way through relevant regulations and case law, as well as the possible consequences that may follow in case of non-compliance with the strictly prescribed form and lack of will (animus donandi) for concluding a contract as an essential component of a donation contract.
