Abstract
U radu se analizira stečajni plan, koji je sukladno Stečajnom zakonu, alternativa „klasičnom“ stečajnom postupku. Iznijeti će se osnovne odrednice o stečajnom planu u Republici Hrvatskoj te će se dati kratki prikaz stečajnih planova u drugim državama čija su prava od komparativnog značaja za domaće pravo, kao što su Njemačka, SAD te druge Europske države. Osim toga u radu su detaljno obrađeni i sastavni dijelovi stečajnog plana te način provedbe i sadržaj stečajnog plana. Posebnu se pozornost posvećuje ulozi i položaju različitih dionika stečajnog plana, stečajnog suca, vjerovnika te dužnika. Cijeli rad popraćen je sa pravnom praksom kao neposrednim pokazateljem provedbe odredbi Stečajnog zakona.
Abstract (english)
This paper analyzes the bankruptcy plan, which is an alternative to the "classic" bankruptcy procedure. The basic regulations of the bankruptcy plan in the Republic of Croatia will be presented with a brief comparison based on other countries whose rights are of comparative importance for domestic law, such as Germany, the USA and other European countries. In addition, the paper details the components of the bankruptcy plan and the manner of implementation and content of the bankruptcy plan. Particular attention is paid to the role and position of the various stakeholders of the bankruptcy plan, the bankruptcy judge, the creditors and the debtor. The whole work is accompanied by legal practice as a direct indicator of the implementation of the provisions of the Bankruptcy Law.
