Abstract
Zbog razlika u pravosudnim sustavima država članica EU, razvoj europskog građanskog procesnog prava ne teče ravnomjerno. Na pojedinim područjima se razvija brzo i intenzivno, a na drugim tek započinje harmonizacija i unifikacija. Ipak, potpunim ukidanjem egzekvature, pravila iz Uredbi omogućuju da se novčane tražbine u prekograničnim stvarima ostvaruju na ubrzan način, uz smanjenje troškova, a posebno uz tehničku pomoć u obliku standardiziranih obrazaca. Ulaskom u EU, nekolicina zaprimljenih i riješenih zahtjeva za izdavanjem potvrde o europskom ovršnom naslovu na nekoliko hrvatskih sudova, omogućila je razvitak sudske prakse i prilagođavanje pravnom sustavu EU sa ciljem da bi se provela pojednostavljena ovrha. Budući da se u budućnosti očekuje da će sudovi zaprimati još veći broj zahtjeva za izdavanjem potvrde, EU posebnu pažnju posvećuje programima izobrazbe sudaca i odvjetnika u primjeni europskih uredaba.
Abstract (english)
Due to differences in the judicial systems of EU Member States, the development of European civil procedural law does not evolve equally. In some areas it is developing rapidly and intensely, while in others, the unification and the harmonization are just starting. However, with the complete elimination of exequatur, rules from the Regulation allow money claims in cross border cases to be obtained in a timesaving manner and with a reduction in costs, especially with tehnical assistance in terms of standardized forms. By joining the European Union, a few received and resolved applications for issuing European enforcement order certificate before different Croatian courts enabled the development of judicial practice and its adaptation to the legal system of the EU with the aim of simplifying execution. Since in the future it is expected that the courts will receive even more applications for issuing the certificate, the EU is focused on training programs for judges and attorneys in the application of European regulations.
