Abstract
Kako bi se zaštitilo javno dobro, osobama javnog prava nije dopušteno to javno dobro otuđiti niti opteretiti stvarnopravnim osiguranjem tražbine. U tom smislu, jedini način raspolaganja javnim dobrom jest davanje odobrenja za vremenski ograničeno korištenje toga dobra. Odobrenje se može dati kao koncesija, ugovor ili upravni akt. Koncesije o kojima govorim u ovome radu, omogućuju osobama javnog prava da i prilikom davanja ovlaštenja imaju na raspolaganju čitav niz instituta kojima će zaštiti taj javni interes ukoliko bude ugrožen. Koncesije su vrlo važan institut jer se njima privatni sektor uključuje u obavljanje javnih usluga. U Hrvatskoj se iz godine u godinu broj koncesija povećava, a time i pozitivni učinci koje sam institut osigurava. Kao izvor podataka za ovaj diplomski rad, koristila sam pravne izvore, odnosno zakone, u prvom redu Zakon o koncesijama, zatim literaturu autora koji su obradili koncesije od njihova povijesnog razvoja, preko dodjele pa sve do vrsta i prestanka, a također sam se koristila i relevantnim web izvorima.
Abstract (english)
In order to protect public goods, persons of public law are not permitted to alienate nor burden them with any kind of real estate claim securitations. In that sense, the only way of disposition of public goods is giving permission for time-limited use of the goods. Permission can be given in a form of concession, contract or administrative act. Types of concessions I am exibiting in this thesis are enabling persons of pulic law to, even in the stages of giving permissions, dispose of a variety of institutions directed to protect public interest if one is endangered. Concessions are of great importance because they connect private sector into public service administration. In Croatia, thru the years, number of given concessions is growing and with it, positive effect that this institute provides. As a resource for my thesis , I have used legal resources i.e. laws , firstly Concessions law, literature of authors who have processed the concessions from their historical development, thru the award, forms and cessation as well as relevant web resources.
