Abstract
Ovaj rad se bavi institutom presude u parničnom postupku. U početnom dijelu rada obrađen je pojam sudskih odluka (kao širi pojam), a potom su obrađeni pojam, sadržaj i učinci presude. Centralni dio rada bavi se analizom različitih vrsta presuda koje se donose u parničnom postupku, a dijele se po različitim kriterijima, od kojih kao glavne kriterije podjele presuda spominjemo: s obzirom na opseg predmeta odlučivanja, s obzirom na postupak koji je prethodio donošenju presude i s obzirom na sadržaj pravne zaštite koja se pruža. Analizirana je pravna priroda pojedinih vrsta presuda, te su razmatrane pretpostavke za donošenje pojedinih presuda prema Zakonu o parničnom postupku, kao i specifičnosti svake pojedine vrste presude. Obrađene su i izmjene Zakona o parničnom postupku koje su se događale zadnjih godina u pogledu tematike ovog rada. Prikazana su određena rješenja razmatranih pravnih pitanja u poredbenom pravu, u onom dijelu koji je ocijenjen značajnim. Osim toga, navedeni su primjeri iz sudske prakse, te su citirani dijelovi sudskih odluka, jer je upravo sudska praksa mjesto na kojem se primjenjuju zakonske odredbe, te je najbolji pokazatelj ispunjava li određena pravna norma svoju svrhu. Naglašena je važnost donošenja presude kao ključne parnične radnje koju sud poduzima u postupku i kojom rezimira i obrazlaže sve provedene dokaze, utvrđene činjenice, te svoje zaključke, stavove i odluku o osnovanosti/neosnovanosti tužbenog zahtjeva.
Abstract (english)
This paper address the judgment in civil procedure. In the first part of this paper judicial decisions are elaborated, than the term itself, content and effect that judgments produce. The main part of this paper consists of analysis of different types of judgements in civil procedure, which are divided according to different criteria. The main criteria for division of judgments are: given the scope of the decision making subject, given the procedure that has preceded the judgment, given the content of legel protection that is provided. The legal nature of the particular types of judgments is analysed, and presumption for adjudication according to Act of Civil procedure. In the last few years there were several changes of law concerning civil procedure and judgments, that were elaborated in this work. Certain solutions of the considered legal issues in comparative law are presented, in the part that was assessed as significant. Furthermore, a number of Civil Court judgments has been collected and elaborated, because case law is the place where legal norms applies and are the best indicator if the legal norm fulfills its purpose. The importance of passing a verdict is emphasized as a main action taken by the court in which it summarizes and explains all the evidence presented, established facts, and its conclusions, views and decision on the merits of the claim.
