Abstract
Kupoprodajni ugovor je jedan od bitnijih ugovora današnjice. U našem pravu uređen je ponajprije Zakonom o obveznim odnosima. Zakon detaljno propisuje sam pojam, karakteristike, tko može biti stranka, te njihove obveze i prava prilikom sklapanja kupoprodajnog ugovora. Isto tako u Zakonu o obveznim odnosima navedene su i uređene i posebne vrste kupoprodajnog ugovora. Kupoprodajni ugovor je prije svega ugovor gdje se jedna strana obvezuje drugoj strani predati određenu stvar , a druga strana ima obvezu platiti određenu cijenu za to. Svaka strana dužna je ispuniti svoju obvezu na način propisan Zakonom i samim ugovorom. U protivnom, može doći do zahtjeva za naknadu štete od strane oštećenog, ili čak i do samog raskida ugovora.
Abstract (english)
The sales contract is one of the most important contracts of today. In our law, it is regulated by the Law of Obligations. The law details the concept, characteristics, who can be a party, and their obligations and rights when entering into a sales contract. Also, the Law of Obligations lists and regulates special types of sales contracts. A contract of sale is primarily a contract where one party undertakes to hand over a certain thing to the other party, and the other party has an obligation to pay a certain price for it. Each party is obliged to fulfill its obligation in the manner prescribed by the Law and the contract itself. Otherwise, there may be a claim for damages by the injured party, or even the termination of the contract.
